Wrongful Caveat

Lisa C Walker (Calgary)

I would like advice on how to sue my Property Management Company to have a Caveat removed on my property due to unpaid maintenance fees that they failed to inform us about. Since becoming aware of the outstanding fees, we have paid the outstanding amount for the maintenance fees. However, the Property Management Company still believe that we should pay their lawyer fees, cost of caveat and additional fees resulting in additional charges of $1500. Our stance is that since the Property management company failed to provide any notice or invoice through any of the methods of communication provided to them, we will not pay the incurred fees, as this is their error not ours. Additionally, I cannot have the Caveat lapsed as I was told "condo fees can't be lapsed". My question is how and where do I proceed through a court of law to have the Property Management company discharge my caveat.

Because lawyers need sufficient information to be able to provide an opinion, and to be able to ask you questions (which usually means at least a half-hour consultation), the lawyers here can only provide basic information and answer very general questions. Please contact a civil or real estate litigation lawyer directly through the Search to seek assistance with your matter. Thank you for your understanding.
